Leading Credit Card Lawyer Calls for Introduction of Prepaid Credit Cards to Alleviate Consumer Debt

May 20th, 2012

LONDON (PRWEB) March 24, 2004

The credit card industry has been heavily criticised over the past few months, culminating with a damning report by the Treasury Select Committee. The industry’s cause was not helped by the outspoken remarks by the chief executive of Barclays, in his evidence to the Select Committee, when he said he had warned his children about borrowing on credit cards as they were ‘too expensive’.

Britons now own over 60 per cent of the 100 million credit cards in issue in the European Union and indebtedness is now reaching near unmanageable levels. The Department of Trade and Industry, in its response to the Select Committee’s report, has advised potential borrowers to ask themselves three questions before taking on credit card debt: How much will it cost? Can I afford it? What happens if it goes wrong?

But is this enough? Robert Courtneidge, a partner at City law firm Osborne Clarke and the UK’s only independent lawyer specialising in credit cards, thinks more can be done. “The Government, the banks and the Office of Fair Trading should be asking what more they can do to help people manage their money better. The DTI said that it was ultimately the consumer’s responsibility for taking on debt, but it did concede that many were too financially illiterate to be expected to behave sensibly.”

In the United States many card providers, through the Visa and MasterCard networks, have introduced ‘prepaid’ cards which have proved to be phenomenally successful. By ‘pre-loading’ their card, users do not face the prospect of getting into debt or paying high interest rates on purchases and cash advances as they are only able to spend up to the amount on the card.

“This is a idea that the UK banks should be introducing,” says Mr Courtneidge. “The concept of prepaid cards is well established in the mobile telephone market, and is a way of avoiding racking up massive telephone bills. The concept could easily be translated to plastic cards in the UK.

“We have two traditional ways of making our purchases,” continues Mr Courtneidge. “With a credit card where it is buy now and pay later. With a debit card where it is buy now and pay now. The industry should be looking to introduce a third way: with a prepaid card where you pay now and buy later.”

Recently, Visa reported that in 2003 greater mainstream awareness and greater popularity of its prepaid cards resulted in a 240% increase in sales and cash volumes. Visa said that the annual volume placed on its prepaid cards now exceeds US$ 1billion and is on track to reach US$ 50billion volume in the next five years. Both Visa and MasterCard have estimated that the US prepaid card market has the potential to exceed US$ 2trillion.

Is being a Paralegal as complicated and hard as it looks in movies?

May 19th, 2012

Question by UrSoWeird: Is being a Paralegal as complicated and hard as it looks in movies?
I’ve heard 2 descriptions of the actual job. In one, it’s a lot of hard work, 24 hours a day, with a lot of time pressure and responsibility. In the other, you’re a basic secretary who files things and takes calls to make appointments.

To a degree. It depends on workflow and number of clients, which unfortunately is down at most law firms these days.

The Law Of Inverse Transformation By Joseph Murphy

May 18th, 2012

What is the law of inverse transformation (law of reversibility) ? It’s somewhat difficult to describe, but when you officially “get it”, your life may never be the same! First, you must understand that all transformations of force are reversible. (Heat is an example of a transformation of force, as is electricity, or controlled imagination, and so is cause-and-effect). For example, if friction (a transformation of force) can produce electricity, then The Law of Reversibility dictates that electricity can produce friction. Is this making sense to you? To put it another way, if a physical fact can produce a psychological state, then IN REVERSE, a psychological state can produce a physical fact. And why does this matter? Well…think of the implications… If you knew exactly how you would feel if you were to realize your dream or objective, and could replicate that feeling mentally, physically, and psychologically (controlling your state of mind), then the Law of Reversibility would automatically cause your objective to be realized. Make sense? Your job then, is to assume and sustain the exact feeling associated with your dream or goal being fulfilled, until such time that your dream objectifies itself. And in order to sustain that feeling, you must live, move, and BE in that state of belief… The belief that you already ARE or HAVE that which you desire. “Get it” yet? Instead of just making a wish and concentrating on your desired outcome, I want you to assume the

What are the duties for a billing assistant for a law firm?

May 18th, 2012

Question by Lauren: What are the duties for a billing assistant for a law firm?
I have an interview set up and I don’t have any experience in legal billing systems. I asked the interviewer if was required, and she just said, not preferrable. I really hope to get the position & I only have Accounts Receivable experience. I figured that she saw this on my resume, but still set me up with the interview. The company uses Elite Billing Systems. The duties included time & exspense daily upload, preparation of month end billing reports, editing & processing of bills, communicating with attorneys etc. Does anyone have any insight on this job description, or anyone work in this position? Will they hire & train? Is Elite easy to pick up?

Best answer:

Answer by Francesca Thomas
All lawyers and paralegals have to bill their time (down to the quarter hour usually but sometimes down to the 5 minutes) to a specific client.

So if they do work relating to one client during a one hour time period, then they will put down that clients name for that hour. If they worked on several clients during the hour – such as making telephone calls, writing reports or doing the photocopying – then they will bill each client for whatever amount of time they did.

When you get those pieces of paper (sometimes done on the computer) you have to write down every client, every lawyer and every billing amount (what each lawyer charges per hour – pro-rated for the smaller amounts of time). So that the accounts dept (or maybe you) can send out the bills.

If you remember the old Tom Cruise movie called The Firm – where the lawyers were charging a LOT more than the actual time they worked for clients. If they worked 2 hours for a client, they claimed it as 3 or 4 hours.

You will need to be very accurate and if anyone ever pressures you into charging more hours when that was not done, well, that is illegal & unprofessional.

Feb. 29, 2012 – Capital Account Interviews CEO James Koutoulus – ‘Shadow Banking System’

May 17th, 2012

CREDITS: www.youtube.com US regulators are holding roundtable talks today about how to protect customer’s money. To keep it from basically being stolen. This is in the aftermath of the MF Global collapse of course. We’ll speak to a lawyer by the name of James Koutoulas who represents 8000 MF Global customers in the bankruptcy. He says new US regulations won’t stop firms from going the way of MF Global so long as they can go to the UK to take on virtually unlimited leverage. He tells us how MF Global was getting around the US leverage limits this way, similar to AIG in 2008, and why it’s going on unchanged. We will talk as well about re-hypothecation, and how “churning” allows brokerage firms to leverage up like banks. And, Federal Reserve Chairman Ben Bernanke gave his economic check up to lawmakers today which meant a reacquaintance with republican presidential hopeful and federal reserve executioner hopeful, Ron Paul. He asked the Fed Chairman if he does his own shopping, among other things, and that if he did, he would know that there is inflation. Well, one thing we have inside knowledge of here at capital account is that, IN FACT, BEN BERNANKE DOES DO HIS OWN SHOPPING AS OUR COLLEAGUE ALYONA CAN VOUCH FOR SINCE SHE SAW HIM AT WHOLE FOODS! Meanwhile, in our segment of loose change, we cover two related stories, both of which strike at the heart of what we call “serf’s anxiety,” otherwise known as the angst experience by members of today’s industrial proletariat
